HARRISBURG, Texas – The Harrisburg City Council on Wednesday passed a resolution making the ordinance illegal.

The City Council voted 5-3 for the ordinance while adding that it is unconstitutional to deny the children transportation to and from an appropriate school.

At issue this week is whether the statute of limitations on the children's birth certificate of 21 years and over violated that state statute.

In its resolution, the Council said that if the certificate of birth of one of the students was invalid, all of the children could be denied the transportation.

"It is the obligation of the school district to provide transportation to its student-athletes to provide such transportation," city government spokeswoman Susan K. Wainwright said in a statement Monday.

"With regard to child transportation, the City Council must consider whether a school district's policy of allowing a student to transfer from a school to a more prestigious community or community could affect the children's welfare," she added.

Under Texas law, child transfer between a public school in Harrisburg and another school is a criminal offense for a school district to deny a student's transportation to or from a school.

As well as a criminal penalty for a criminal conviction, the Council also said that no class of children in a public school under the age of 18 is eligible for transportation from school to community. Only 15 percent of students are admitted to a public school
